Its the orange "Engine light for the exhaust emissions have deteriorated" warning light and has not failed any MOT's on it. The chap at the garage said that BMW's are a pain in the a*** for warning lights, and since it was just the fuel mixture light and no issues with the emissions since then not too worry about it too much, the original fault was code E3. As the emissions have all been fine since 11/08/10 I have just left it. It does reset but come back on after a few days, I did not want to get it reset again or as some would have done and take out the bulb, I am being honest about it. From what i understand new MOT is for dashboard warning lights that show a problem such as Airbags, Electric Power Steering, Electonic stability sytem and additional restraint systems; since this light is not related to restraint systems and all the relevant emissions tests are good it should not be a problem. It has had 2 MOT's since with no emission problems.

We had a similar ongoing problem with the EML on the Z4. The indie reset it twice and then I spent an hour with him and in the end believed what the code reader was saying and paid £200+ to have a new sensor fitted. 3 weeks later EML back on and we found a tiny crack in the exhaust manifold that cost £100 to get welded. IMHO if the exhaust emissions are OK for the MoT then the EML isn't likely to be anything serious but at £2,500 (assuming HPI, etc are OK) then it looks like a good buy.

Even decent Zeds with no real probs are not much more, I would always pay that little bit extra and go for one with no faults or hastles, without actually seeing it, it might have been a heap.
